Terms and Conditions

The following Terms and Conditions of Sale apply to all products and services provided by B-Sealed Pty Ltd ("B-Sealed") and apply to any and all orders placed by the customer ("Customer"). Please make sure you choose carefully as all products are sold on a no refund basis, unless proven to have been faulty at time of sale. B-Sealed’s return policy on goods that are faulty and accepted by B-Sealed is to exchange for goods of equal value or to provide a credit towards the purchase of other goods at B-Sealed's discretion.

These Terms and Conditions may be updated by B-Sealed from time to time.

 

All orders are subject to acceptance and confirmation by B-Sealed.

The title of goods shall not pass to the buyer until full payment has been received and cheques are cleared by B-Sealed.

Terms and conditions of payment for the Goods and/or Services are strictly CDB (Cash Before Delivery) unless otherwise agreed and specified on invoice. Payment by other than Cash or Cheque (by prior arrangement only) may attract additional administration charges. Lodging your Credit Card details with B-Sealed can be used as the method for payment before delivery.

B-Sealed cannot deliver to third party addresses unless otherwise agreed.

B-Sealed will not be responsible for goods lost or damaged in transit.

The Customer is responsible for any costs incurred by unclaimed goods or refused shipments.

The Customer must ensure that someone is available at the delivery address to accept the goods. B-Sealed will use its best efforts to ensure that delivery is timely but cannot be held liable for any delayed or lost goods.

In the event that a delivery attempt to the customer's provided shipping address is unsuccessful due to circumstances beyond B-Sealed's control, including but not limited to incorrect address details, unavailability of the recipient, or any other factors not attributed to B-Sealed, undeliverable charges may apply. The customer shall be responsible for bearing the undeliverable charges incurred. These charges will be calculated and specified in the invoice.

In cases where a redelivery is necessary due to reasons beyond B-Sealed's control, including instances where the customer requests resending of goods to a different address or scheduling a new delivery attempt, redelivery charges may be applicable. The customer acknowledges and agrees that the redelivery charges will be at their expense and will be clearly outlined in the invoice.

All undeliverable and redelivery charges will be itemised and included in the customer's invoice. The customer shall be responsible for making prompt payment for these charges as specified in the invoice.

In the event that the customer believes that undeliverable or redelivery charges have been inaccurately applied, they must promptly notify B-Sealed in writing, providing a detailed explanation of the dispute. B-Sealed will review such disputes in a timely and fair manner.

There may be circumstances that require additional payment by the Customer if the conditions mentioned have not been met or may require special services outside of B-Sealed's standard delivery. This may include a specified delivery time window, or if the Customer's address is not tractor trailer accessible, or not available for the scheduled delivery, delivery not made due to unsafe conditions, not indicating missing pieces on the delivery note, etc.

 

B-Sealed does not guarantee product compatibility. On special request, non-faulty products returned for credit must be done so within 14 days of invoice date, unopened, unused in its original packaging and will incur a 20% restocking fee of the lower price of either its invoiced value or market value at the discretion of B-Sealed. No goods will be accepted for return after 14 days.

Discounts given during promotional periods are not redeemable for cash and will be proportionally deducted in the instance of refund/credit if approved by B-Sealed.

Goods sold on "back-to-back orders and no-return" basis will be identified by B-Sealed and cannot be returned or cancelled.

Customised and made to order Goods cannot be returned or cancelled.

In the event of a return for credit, B-Sealed will deduct the cost of freight incurred from the amount refunded.

B-Sealed will only accept responsibility for adherence to technical or performance specifications by any goods to the extent that the Manufacturer of those goods accepts that same responsibility.

B-Sealed covers all goods for a 1-year warranty unless specified otherwise by B-Sealed.

B-Sealed will not accept, refund or replace any damaged goods caused by misuse or improper handling.

The Customer must ensure that all artwork, whether in electronic form or otherwise, aligns with B-Sealed's specifications. B-Sealed disclaims responsibility for file-related errors that may impact the quality of the Customer's job and does not accept liability for files that are not print-ready. While we take utmost care, variations in product and print colors may occur between prints, stocks, and jobs. B-Sealed assumes no responsibility for these color differences resulting from distinct printing processes or stocks.

The Customer affirms to B-Sealed that they hold copyright or a license allowing B-Sealed to reproduce all supplied artworks (in electronic form or otherwise) for the Job. The Customer explicitly grants B-Sealed the authorisation to reproduce all such artworks for the Job.

The Customer agrees to indemnify and hold B-Sealed harmless from any liability, losses, or expenses arising directly or indirectly from any breach of copyright or rights related to copyright in any artwork supplied by the Customer.

Unless Customer and B-Sealed agree otherwise, the copyright in all Goods created by B-Sealed is the property of B-Sealed.
